IP checklist before entering the China market

A practical checklist of what foreign brands should secure and put in place before manufacturing, selling or exhibiting in China.

Most China IP problems can be prevented with a few steps taken before launch. This checklist is the one we use when advising companies on market entry.

  1. Run a clearance search for your brand name, logo and Chinese name before you commit to them.
  2. File trademarks in the right classes, in English and Chinese, plus related classes that matter for your goods.
  3. File patents before disclosure: before trade shows, product launches or sending drawings to suppliers.
  4. Register key copyright such as software, artwork and packaging designs.
  5. Review manufacturing and distribution contracts for IP ownership, non-use and confidentiality clauses.
  6. Record rights with customs once registrations are granted.
  7. Secure brand assets online, including domain names and marketplace or social media accounts.
  8. Set up monitoring for conflicting trademark filings and counterfeit listings.
