Copyright registration and protection in China
Copyright arises automatically on creation, and China is a member of the Berne Convention, so foreign works are generally protected. Registration is voluntary, but it gives you prima facie evidence of ownership and usually makes enforcement faster and cheaper.
What we handle
- Registration of software, artwork, product design drawings, photographs and written works
- Recordal for customs protection
- Ownership and licensing documents for works made with Chinese manufacturers or agencies
- Takedown complaints on e-commerce and social platforms
- Infringement claims where copyright overlaps with design or trademark rights
When copyright matters most
Copyright is often the fastest route when a competitor copies packaging, catalogues, product images or software, especially where no patent or trademark exists. We assess whether copyright, design patent or trademark gives the strongest position for each case.
Questions we hear most
Do I have to register copyright in China to be protected?
No, protection arises on creation. Registration is not required, but it helps prove ownership and is useful for enforcement and customs recordal.
Who owns copyright in works made by a Chinese agency or manufacturer?
Ownership depends on the contract. If it is silent, the creator may own the work. We recommend clear assignment clauses before work starts.
Can copyright stop counterfeit goods at the border?
Customs recordal can be used to request action against infringing goods. We advise on whether copyright, trademark or both should be recorded.
